For most of the processing activities, we collect consent to them from you. Then Art. 6 I lit. a and Art. 7 GDPR are the basis for processing activities. On our website, tools from companies based in third countries, are integrated. When these tools are active, your personal data may be transferred to the servers of the applicable companies. In this case we have signed additional contracts to be compliant to the European data protection legislation.

We collect, process, and use personal data only to the extent necessary for the establishment, content organization or change of the legal relationship (data inventory). Data that you provide to us under the sections “Request information material”, “Register online” and “Apply online” are processed using the CRM solution Salesforce, among others. This solution is also hosted outside the scope of the EU Data Protection Directive an appropriate level of protection is proven here (see also the extended requirements of the “Düsseldorfer Kreis” and “der „Konferenz der unabhängigen Datenschutzbehörden des Bundes und der Länder“ (DSK)”) . The data collected will only be used for the purpose of sending information material, in the case of consent to the sending of advertising for this purpose, or in the case of an application for an educational offer for the purpose of initiating a contract. Among other things, MailChimp is a service that can be deployed to organize and analyze the sending of newsletters. Whenever you enter data for the purpose of subscribing to a newsletter (e.g. your e-mail address), the information is stored on MailChimp servers in the United States.

With the assistance of the MailChimp tool, we can analyze the performance of our newsletter campaigns. If you open an e-mail that has been sent through the MailChimp tool, a file that has been integrated into the email (a so-called web-beacon) connects to MailChimp’s servers in the United States. Execution of a contract data processing agreement

We have executed a so-called “Data Processing Agreement” with MailChimp, in which we mandate that MailChimp undertakes to protect the data of our customers and to refrain from sharing it with third parties.

 

  1. b) Mailingwork

This website uses Mailingwork to send newsletters. The provider is Mailingwork GmbH, Schönherrstraße 8, Gebäude 10d, Eingang N, 09113 Chemnitz. Mailingwork is a service with which the newsletter dispatch can be organized and analyzed. The data you enter for the purpose of receiving newsletters (e.g. e-mail address) is stored on Mailingwork’s servers in the EU.

Our newsletters sent with Mailingwork allow us to analyze the behavior of newsletter recipients. Among other things, we can analyze how many recipients have opened the newsletter message and how often which link in the newsletter was clicked. With the help of so-called conversion tracking, it can also be analyzed whether a predefined action (e.g. purchase of a product on our website) has taken place after clicking on the link in the newsletter.

The data processing is based on your consent (Art. 6 para. 1 lit. a GDPR). You can revoke this consent at any time by unsubscribing from the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

The data you provide for the purpose of receiving the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted from our servers as well as from Mailingwork’s servers after you unsubscribe from the newsletter. Conclusion of a contract for processing on behalf of the Controller

We have entered into an processing on behalf of the Controller contract with Mailingwork and fully implement the strict requirements of the German data protection authorities when using Mailingwork.

 

  1. c) Postal advertising

We use your address in compliance with all legal regulations for the dispatch of postal advertising (postal advertising).

The legal basis for this is our legitimate interest in direct advertising according to Art. 6(1)(1)(f) in conjunction with Recital 47 GDPR. If a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR; the consent can be revoked at any time. More specific regulations may be communicated to you if necessary in the context of data collection and take precedence over the present regulation.

Your address will remain with us until the purpose of the data processing ceases to apply. If you assert a justified request for deletion or revoke your consent to postal advertising, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. tax or commercial law retention periods); in the latter case, the deletion will take place after these reasons no longer apply.

Execution of a contract data processing agreement

In order to guarantee processing in compliance with data protection regulations, we have concluded an order processing contract with our host.

  1. Analysis, Brand and Opinion Research

We analyze our database of business transactions, contracts, inquiries in order to be able to recognize market trends, customer and user preferences and to design our operation economically. In doing so, we process inventory, contact, usage, contract, meta and communication data of interested parties, applicants, students and visitors to our website on the basis of our legitimate interest in maintaining and optimizing our business operations pursuant to Art. 6 (1) lit. f GDPR. Such analyses are carried out for the purpose of business evaluations, marketing and sales, as well as market research. These analyses serve to optimize our offer, to increase user-friendliness and to optimize our business operations. The analyses and profiles are carried out anonymously wherever possible and are not disclosed to third parties.

To enable our chatbot to understand the texts you enter and send back suitable answers, we use an artificial intelligence service called IBM Watson from IBM Deutschland GmbH, IBM-Allee 1, 71139 Ehningen. To analyze your text input, the following data is transmitted to servers of IBM:

  • All sent messages in the chat (individually).
  • The exact time when sending.
  • Information about the chatbot that is being used.

The data is stored in a data center in Frankfurt for a maximum period of 3 months. IBM assures us to store the data in Germany and to use it exclusively for the analysis of the messages. Furthermore, there is a corresponding order processing relationship with IBM. The corresponding use of data is based on Art. 6 para. 1 p. 1 lit. b GDPR in the context of processing your request.

 

  1. d) Unibuddy

We are providing the chat service Unibuddy on our website for a direct communication between prospective students and current students. Unibuddy does not process data using our own servers. To use the chat service, it is necessary to set up an account with Unibuddy and to accept Unibuddy’s privacy policy, which can be viewed at the corresponding site. The embedding of Unibuddy is based on your consent according to Art. 6 para. 1 lit. a DSGVO. Due to the fact that the service provider of Unibuddy also processes data in a third country, contracts according to the European Standard Contractual Clauses as well as a contract for processing on behalf of the Controller according to Art. 28 GDPR have been concluded with the service provider to ensure the legal conformity of the data transfer. Furthermore, the provider of the tool processes all the technical data required for the processing of the online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or loudspeaker and the type of connection.

Should content be exchanged, uploaded, or otherwise made available within the tool, it is also stored on the servers of the tool provider. Such content includes, but is not limited to, cloud recordings, chat/ instant messages, voicemail uploaded photos and videos, files, whiteboards, and other information shared while using the service.

Please note that we do not have complete influence on the data processing procedures of the tools used. Our possibilities are largely determined by the corporate policy of the respective provider. Further information on data processing by the conference tools can be found in the data protection declarations of the tools used, and which we have listed below this text.

Purpose and legal bases

The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6 para. 1 sentence 1 lit. b GDPR).
